By placing an order with Coby Delaney Website Services, you confirm that you are entering a legal contract, and are in agreement with and bound by the terms and conditions below.

General Terms

Coby Delaney Website Services takes all due care to ensure any software is free of errors and bugs, however cannot accept responsibility for losses incurred due to malfunction.

The client is expected to fully test all software created by Coby Delaney Website Services prior to implementation. Where software errors and bugs are found within a three month period after implementation, Coby Delaney Website Services will fix these issues free of charge. After this three month period, all additional bug fixes will result in an invoice at our hourly rate.

Coby Delaney Website Services will place a link to http://www.cobydelaney.com.au in the footer of each page of the site. Removal of this link is at the discretion of Coby Delaney Website Services and may incur a additional cost.

Coby Delaney Website Services cannot be held liable for costs incurred, loss of income, or compensation due to the failure to meet a previously agreed deadline.

Coby Delaney Website Services cannot be held liable for any disputes between a site owner and any other party, nor be held responsible for any misuse of the software by the site owner.

Code Ownership and Copyright

All aspects of the website and software remain the property of Coby Delaney Website Services until all outstanding accounts are paid in full. In addition, all PHP scripts, database schema and software remain the copyright of Coby Delaney Website Services (unless prior agreement dictates otherwise), and may not be reproduced or resold commercially without express permission of the developer.

The website, graphics and any programming code remain the property of Mooty Web Design until all outstanding accounts are paid in full.

Payment of Accounts

A deposit is required with any project. This is non-refundable. The size of the deposit depends on the size of the project, and will be determined in advance of the project being commenced. This amount is generally 20% of the full quote.

The remaining balance of the account can either be paid on a schedule as suggested by the client, or as a lump sum prior to implementation. Coby Delaney Website Services is open to all offers of payment terms, and will use their discretion in agreeing to specific terms.

Once the software has been completed the balance of the account is due in full. There are no exceptions. Non payment may result in legal action.

Changes to the Terms and Conditions

Coby Delaney Website Services reserves the right to change these terms and conditions at any time without prior notice.
